Telephone Consumer Protection Act(TCPA)
The 1991 federal law (as amended) that governs outbound telephone calls, SMS, and fax in the US.
What it means in practice
TCPA is the dominant legal framework for US outbound. Key requirements: prior express written consent for autodialed marketing calls to cell phones, express consent for prerecorded calls, calling-window restrictions (8am–9pm local), national DNC compliance, and the predictive-dialer abandon-rate ceiling (3% of live answers over 30 days). Violations are $500/call base, up to $1,500/call willful.
